The police tazering him was completely uncalled for. Even if he was being uncooperative, they could have used some other method, like you said.
Furthermore, EVEN IF the officers had given the man a legitimate reason along with proof, EVEN IF the man was a complete douchebag to the officers (hypothetically), and EVEN IF the citizen was in the wrong, this is simply a horrific display of the cruelty and abuse of power shown by these specific officers. A man with his hands over his eyes, who has not once shown a sign of aggression, is not a threat. Yet these men were so eager to shove him into glass, drag him out of a vehicle, taze him SEVERAL TIMES, and step on his head, pushing his face into asphalt............................But no, you say he was resisting arrest. So this is what happens? This is just? This was deserved?
Oh and by the way, what exactly are you hinting at? If the police had known that the citizen was a pastor, would they have reacted differently? You seem to be taking on a very "oh it's fine, they just didn't know any better" attitude.

The cops abused their power, sure, but he was obviously hiding something if he didn't just let them search his trunk, big deal.

Then a cop pulls you over and demands to inspect your vehicle. You've done nothing wrong, but you still really don't want this random cop to see you new porn collection.
in short, there are PLENTY of reasons to not want your car searched even if you've done nothing wrong. But most importantly, the cops have NO RIGHT to search a car without a warrant. If they TRULY had probably cause, they could have detained the man while waiting to get a warrant filed.
But once we start allowing police officers to search property without a warrant, we are giving away all of our freedom. If cops could search your house whenever they wanted to, then your house might as well be property of the state.
I do agree that this would not have been such a big deal if he was not a pastor.

Could the pastor have handled it differently? Yes. Could the cops have been more professional? Definitely. The video makes police, who already have many years of bad reputation surrounding them, look that much worse.
The only cause these officers had were their own suspicions. They see someone resist their questions, so they think "this guy is hiding something". They clearly used the dog as a way to bypass the law.
This guy did absolutely nothing wrong. Everything he did was well within his legal rights, and I guess these days the law doesn't even care anymore.
You can go on like "OH WELL HE COULD HAVE HAD A WEAPON ON HIM BLAH BLAH BLAH" but there's a HUGE difference between could have, and did. This man did NOT have a weapon on him, they had no reason to suspect he did, and had no grounds to remove him from the vehicle. You can go ahead and say "WELL HE COULD HAVE..." but the fact is that he DIDN'T. Which means what? They fucked up. They did their job wrong. I've taken Criminal Justice, I work for an ex-police officer. If a police officer just randomly chooses me to pick on like that, I'm not going to comply. And why? Because I don't have to. If they have no grounds to prove I've done something wrong, I don't have to let the search my stuff, and I won't.

Any movements while being tazed are completely involuntary, therefore making it impossible to resist anything (which I believe is the whole point of a tazer in the first place). Apparently "paralysis" implies enough muscle control to intently resist arrest.

But at the same time, it sounds like he was being difficult. It's been awhile since I've taken a law course, but at least in Canada, you only have to give your name to a police officer if asked. So while he didn't HAVE to answer the questions, this probably wouldn't have happened if he'd just answered them. Of course the police are going to be suspicious if he refuses to answer. They'll be even more suspicious if he refuses to have his vehicle searched.
It was completely ridiculous of the police to place him under arrest. They should have brought the dog out again, within full view of him and the highway safety officer.
And his hands were covered, they didn't need to use one taser, let alone the number they used. Definitely an abuse of power, but I think this could have been avoided had he just answered the questions. But all in all, what the police did was pretty disgusting.

When a police officer tell you to do something, you do it. If the guy would have obeyed the police officer and gotten out of the car, he wouldn't have been arrested unless he had something unlawful he was hiding. He spent more time being beligerent than being cooperative.
Bottom line is that we rely on law enforcement officials to protect our society from illegal activity. When some self-rightous pastor decides to challenge their authority, they are going to react just like a judge would if you called him an asshole while you were in his court. That judge is going to hand you a much stiffer punishment than he would have if you had kept your mouth shut.
The way our great country works is we elect people into power to put other people into places of authority. We don't get to pick and choose when we wish to obey people with this authority. If you want to argue about what is right and wrong, that is what our court system is for.

The job of the border patrol agents are to ensure nothing illegal is getting transported past the border. When I get stopped at the air port at a random security checkpoint do I have the option to say no thanks, I'm good? No, if i want to cross that checkpoint I will need to comply with the authority figure asking me to do something. If I resist, then that raises suspicion and I'm definately not going thru without a search.
Would you get on a plane with someone refusing to go thru a security checkpoint and the authority figure says my mistake, I have no right to search you. Please let me carry the bag to the plane for you.
I agree with you that cops need a reason / warrant to enter your vehicle or house when you are not at a freakin security checkpoint. Thats the whole purpose for the checkpoint. The border agents said the dog indicated a search was necessary, so they called the local police to enforce the law so that they could do their jobs. PROTECTING THE BORDER!!!
Just because they wear the same uniform as other law enforcement does not mean they are the same law protecting enforcement that is portrayed around America.
Not reading someone's rights, Not bringing out the dog to sniff anything, Not finding anything, Not respecting an individual's rights, assaulting and battering a citizen exercising their rights as a citizen, and making fun of them is not professional and is no different than common criminal.

It is unfortunate that this happened and events similar to this have been happening recently, part of this is due to the powers the government has been given since 9/11, the partriot act and such. Now police, and border partols have the power for search and seizure without a warrant as long as they believe or think (without proof) that there is probable cause.
I agree that the police used excessive force and could of easily just dragged him out.
Also, at the part where the guy asks him to close his eyes. Why didn't he just step out the car or question why he was been asked to close his eyes.

There's his right, and the right of Americans, right there. You should not be considered suspicious if you know your rights and enforce them. If you watched the second video, he obviously had nothing to hide and was enforcing his rights.
I will say that I believe he was pushing it due to the attitude he gave the cops, but I also believe that the cops overstepped their power by tazering him like they did and then beating him. He was being verbally resistant, but he was not being physically resistant as far as I can tell, therefore such force against him should not be necessary.

Just because someone resisted arrest in the past and hurt an individual officer does not entitle that officer to use excessive force in subduing someone. You are to use the minimum force to safely subdue the person. A single tasing would have done it. Heck, warning him that he would be tased and forceably removed from the car in he didn't comply may have been enough.
That bitch just had to listen to the police officer, especially when they have been there asking him to get out of his car for over an hour as he said.

In the end the guy i borrowed the car from was drunk and forgot he lent it and called it in stolen.
This guy is going to clean up in court and we the people are going to end up paying for a good portion of it. If he's smart he'll sue both departments and every individual officer that was present, for the actual beating or for the officers failure to protect his rights as well as to protect him from the use of excessive force.

This is BORDER PATROL not random cops. If you cross the US border then you do what they say or you can return to the USA. He did not and could have had a weapon. He resisted a search AT THE BORDER and was then considered a threat. That threat was neutralized by a tazer. Life goes on.

One last thing the Police have the legal right to detain someone 24 hours with no cause. No more than that but that meant the Officer even if there were no drugs was acting legally til after the tasering. Everyone at the airport goes through a metal detector. If you beep, you get searched. The dog is similar. If the police let him go, the same bubble-heads who are sympathizing with this little bubble-headed drama queen would complain the police weren't doing their job.
We have different rights in different contexts. In this context, entering our country, we, the American public, have the right to have you, the American international traveler, searched for contraband, so we, the American public, don't have narcotics being sold in our cities, or illegal aliens in our territory.
If our elected officials choose to put checkpoints on state borders, then yes, it is our civic duty to follow instructions for inspection there as well. If we don't like it, we write our congressmen, and if that doesn't work, we vote in new leadership, as we did recently.

The cops did not even express what they were charging him for. You MUST tell the person what you are charging them for before you are allowed to progress further. They did not even do that, therefore they had no right to do such a thing to him.

As citizens of the US, we have rights given us by the US Constitution.
This may seem like a relatively stupid reason to not submit to police, but the more we just capitulate the more we lose our rights.

You're coming from work, and a bunch of cops decide to stop you. You ask for their reason and after a bit of talking they finally tell you that you're being accused of having drugs and/or a dead body due to a dog who did nothing but sniff. It didn't bark, it didn't make a sound, it just sniffed and left.
Then after you ask the what the dog was supposed to do to indicate the confirmation of drugs and/or a dead body, they ignore you. Then they break your window and taser you, slam your head into a broken window and then drop you on the ground and stomp on your head.
Once again I will say this, the cops did not have to right to use such brute force, and I certainly don't think you would love for this to happen to you. Especially being accused of something you had not done.
I'll say this once more. Think before you speak, or in this case, type.
You can't be arrested for cops thinking you have drugs on your person.
They have to have PROOF, they have to have the drugs in their possession. They said he had drugs in his trunk, yet he didn't have any.
Yes he is going to be arrested for resisting arrest for that hour that he barricaded himself in the car, and possibly for obstructing justice.
Also when they show the actual surveillance video of the dog walking by and not actually finding anything, I'm sure the judge will see this for what it is; Cops trampling over someones rights and using obsessive force because someone got a little overzealous about their rights.

He was informed on video tape that he was under arrest for failure to comply. Not only did he resist to that. He started resisting once he refused the search of the vehicle ( which by the way was a rental car so who knows what the dog sensed on the vehicle).
He practically instigated the whole thing. Conveniently having the camera at hand. If they are going to break the window. You already know they are making their way in so why not unlock the door?
The first video only shows a portion of the incident. He fills in the gaps on his second video. He spoke about the incident. How are we to believe him when in he clearly has no idea how his civil rights work.

They had no right to arrest him, they didn't have probable cause because they didn't get signaled by the dog drugs were in the car (according to him). If they were drug sniffing, and they did get signaled by the dogs, dogs should no longer be allowed for obtaining probable cause. Because obviously they can not be trusted. (No drugs or anything else were found)
He resisted arrest (for a crime which he did not commit. He refused a search which was within his rights, (and the search was not warranted) Boarder searches are legal, this was not a boarder search, this was well within the nations boarders. The cops did not inform him about shit for which he was breaking the law. The used execessive force, they did not even attempt to use natural means to subdue him after breaking the windows. They tased him multiple times. (he was calm, collected, and did not appear to pose any phyical threat to the cops, as such tasers werent warranted.

So your right, he was just doing his job, but he did it TERRIBLY. Given the situation there is no excuse for the level of force used against him, and we do have certain rights as far as questioning goes, and the actions of these cops lead my to be very suspicious of their intent.

PS: Oh by the way, for all you who are against the police here, many police dogs are trained to have very subtle signals that civilians don't necessarily notice. But that doesn't change the fact that they wouldn't bring it back out, which is very suspicious. However, since they found nothing, I wouldn't be surprised if the dog didn't in fact give the signal.

A police man pulls you over and asks you to strip down because their dog showed you had drugs or something in your clothes. Would you do it then? The way I see it its the same example of what happened to this man. He refused to be searched like you wouldn't want the police to strip search you when they didn't even had a good enough reason.

If you are in custody, being interrogated, and you are not read them, then what you say can't be used against you (generally, but there are some exceptions to that). You have no right to have your rights read to you. It only keeps what comes out of your mouth usable in a court of law.
My personal opinion is that the police should have done some kind of profiling and they should have come to see he was not very suspicious looking. Upon seeing that, they should have then answered his questions about his rights. If they had answered his question and shown him libel proof of probable cause, then he most likely would have cooperated. The police used excessive force and all involved in the tasering should have their badges taken away for abuse of power.

I think he essentially approaches Border Patrol with a bad, uncooperative, aggressive behavior in an attempt to bate them on into a game of who knows the law better and who is going to fold. Sad on both sides.

There was a supreme court case that basically said "You need a warrant to search a house" No exceptions.
A car is different, if they smell it or see it they have a right to search, and if you refuse you are now resisting arrest, which is why once they said the dog found something, which it didn't, he should have got out of the car and taken the video to a lawyer and sued the hell out of them. I'm kind of sad he didn't because he might have thrown that chance out of the window.

Now, with a car, its different. If they find probable cause they can go ahead and search your car without a warrant. While I think that the guy should have just got out of the car, the cops went way too fucking far and I hope they get their asses kicked.

1) Police may search your car without a warrant. They cannot do so without demonstrateable reasonable expectation of evidence of a crime being present. A positive K9 inspection is acceptable.
2) The pastor has the right to observe the police. This means he has the right to videotape, and he also has the right to witness a K9 inspection before the police may search his vehicle.
3) The police may detain the pastor for up to 72 hours in most states, without arrest. However, if the police office states his intent to arrest vs. detain, than the pastor has the right to know what he is being arrested for. The cop must announce a specific criminal offence as defined by the state's criminal code.
4) The pastor has no right to resist arrest, even arrest he feels is unlawful. In this situation, once the police chose to declare their intention to arrest, the pastor has the legal obligation to comply. His proper response to such an unlawful arrest is not to refuse it, but to bring it to the courts formal attention. This can be done by a complaint with the police department, state department or court system, and/or through the placing of criminal charges and/or civil lawsuit. Of course, always speak with your lawyer.

1) If he did nothing wrong, and the police officers and boder patrol truly had no probably cause to arrest him, he has the right to leave.
2) If they DID have probable cause, they should have stopped after one taser, and handcuffing on the ground. Even then, i don't see the reason for using a taser. Just because it's "non-lethal" doesn't make it your toy to use on people whenever you want. And there have been deaths connected to cops tazering people, so its not 100% safe. What if the guy has a heart condition? You'd feel pretty fucking dumb after finding he was innocent, AND a pastor.

As we all saw and heard in the video the cop asked him to exit his car due to the dog alerting them for whatever reason. Those who have nothing to hide, and those who are not thinking they are above the law, would have gotten out of the car to prove the cops wrong.
Dogs (regardless of what they are trained to sniff out) can make mistakes (although very rarely due to their training). He was told the dog smelt something, and with the drug issues in Mexico the border control are cracking down on drugs (and always have).
All of that could have been prevent if he got out of his car. And becaue he was being beligerent with the cops and not doing as asked, they had every authority to tazer him. When it comes to uncooperative suspects and in situations as his, it's taze first, read him his rights later (regardless of location).
I personally believe he was putting the border control to the test. It was almost like he was testing them to see how serious they truly are.

As for the cop who was speaking to him, yeah...the cop should have chosen better words to get the man to listen, but he did nothing out of regulations. And because we did not see inside the car as the pulled him out, we do not know if he is fabricating them beating him or if, when drug from the car, he cut his forehead on the glass that would have been on his seat and floor.

The police officer gave no specific reason to place him under arrest, and then ended up saying "I'm an officer you have to obey me." "I'm placing you under arrest for resisting arrest." (Being arrested for resisting arrest for what though?)
Now I see that because the pastor was stubborn and refused to let them search his car, that would spark suspicion and all, but to taser him as much as they did? 1) Refusing to answer questions (we're talking about the ones they initially asked such as what are you doing etc. etc.) gives them probable cause. Just because you refuse, does not mean that they can let you through. That makes them suspicious and gave them the right to bring in the dog.
2) Dogs do not need to make a noise when they find something. They often will mark the drugs by pawing at the spot where they are hidden. If there was nothing illegal and they did lie, then they acted wrong
3) Resisting Arrest is a crime you can be charged with and arrested for. They did have the right to taze you THE FIRST TIME. The beating and glass in your head and additional tazes were not called for because you ceased to resist.

That said, and while I believe both parties were in the wrong, those police officers had absolutely no reason to taser the Pastor more than once, if at all. Everyone has a right to be an asshole, and frankly the guy has an explanation video up the next day, obviously he wasn't charged with anything, meaning they didn't find anything. Taser's aren't meant to be used in that situation, he was highly outnumbered and the officers had an advantage on him, regardless if he had any weapon.
Frankly it doesn't matter who he is, there have been a number of people who have died from Taser's, in Canada there was one recently that I remember. And he had a lot of media coverage, so it doesn't change things that he's a pastor. If he was there over an hour, why didn't they acquire, or at least try to acquire, a warrant? If they think they had a right to arrest him, shouldn't they be able to get a warrant?
Legally he did nothing wrong and the cops are completely to blame, also he wasn't belligerent. Belligerent means he's warlike or aggresively hostile.
Firstly, I'd like to mention that the police DID use excessive force. I do believe that they had no need to taser him. The rest of his story has yet to be proved, but if it does turn out to be proved, then the police were also wrong in hurting him even more.
Secondly, there's the issue of whether or not he deserved it. Well, this in itself is a stupid question. Whether or not he deserved it, if we could all go around shoving tasers at people who we thought deserved it, this country would be more chaotic than it already is. No, the real issue is: could he have avoided this by simply complying with the police?
Some people say that "if you are so willing to give up your rights, then maybe you don't deserve to have them". Oh please. This strikes me as incredibly naive. Think about it: surely there has been a time in your life where a teacher or another authority figure has asked you to do something. You say no and argue that you have the right not to, but in the end, you simply end up in more trouble.
Do you get my point? Surely, a police officer is different from a teacher. But think about this from the officer's point of view: this guy might have something suspicious on him, and he refuses to let you search his car. Obviously, you would think something's up. Of course, in the end, there was nothing to be found. But the police have to operate as if every scenario were a worst-case scenario, for our safety. It's like someone said before, would you feel very safe if airport security let someone onto your plane who wouldn't let their bags be inspected?

Dogs alert in ways that are clearly seen or heard, such as sitting, barking, etc. so I think I would've been asking for the dog to be brought back out if I hadn't seen/heard it alert, too. I mean, one this guy knew there was nothing in his car to alert to, and seeing as he didn't catch the dogs alert, I'd probably have done the same thing, though it's much easier to just let them search if you have nothing for them to find, but it's the principle of the thing. This guy may have been stubborn, but I wouldn't been to, if I was being held up by someone wanting to search my car with no reason. If the dog had made a mistake (which dogs don't do often) and alerted, I'd be more likely to say, okay, well they have a reason, so let 'em look. But if they brought out a dog who i didn't see alert to anything, and they STILL wanted to search my car with no reason, they don't have the right, and I wouldn't waste my time letting them.
While this guy may have been a bit rude, it was perfectly within his right to not let them search without them having probable cause or a warrant. And I think what they did to him, was absolutely HORRIBLE. It's an abuse of power, and it happens far too often in this country. Some police officers these days seem to think they're so high and mighty that the laws don't apply to them and they can do whatever they want with no reason. And when someone questions there authority, implies that just maybe they DON'T have a probably cause or warrant and just wanna search for the heck of it, they get offended and mad. But they should know the law, and they should obey it, they should keep there cool, and try and give the person as much information as they can. They usually even tell criminals who are pretty much clearly guilty, caught in the act, what they're being arrested for, so they should definitely try to make it clear to someone who may be more confused about what they've done wrong.
While overall, a bit of blame can probably be placed on both parties, though I'm not shocked, I feel that it's horrible for law enforcement officers to be that violent with no real reason, and to try and dance around questions that they should have a definite answer for before they want to search or arrest someone. I mean, the pastor is only human, and some humans are stubborn and hate people implying they did something wrong, and feel the need to challenge them. While the officers are only human too, they go through training to know how to d their job right, and should be able to handle situations such as this better. And beating the shit out of someone isn't just a "human" mistake, not like being a bit irritable, having an off day, no one can beat the shit out of someone, and say "oops, I'm only human".

This is not to say in any way that the officers involved were justified in their actions. The use of force was excessive for the situation. For entering the vehicle a set of slim jims (the tools not the food) could have been used. Even if the window had to be broken he could have been removed in a much more civil manner. The use of the taser seems to me to be unjustified for the situation. Although I think that if the officer had clearly stated what the charge was. He could have said something like “resisting arrest” rather than “disobeying me”. Just as easily the dog could have taken another pass at the car.

Now I don’t know what other loop hole and such that may be in place in that state or laws written on the subject other so I can’t definitively say. Regardless of how this plays out in the inevitable legal proceedings both sides could have handled the situation better. The use of excessive force is hard to ignore in this case. Weather or not the search was warranted I doubt that the pastor will suffer any legal consequences from the event, I can’t say the same for the officers.

1. "I asked them to tell me what the dog had done..." They're not required to tell you what the dog's alerts are.
2. "I asked them to bring the dog back because I say it didn't happen..." That doesn't matter, and they aren't required to do so. If you get pulled over for speeding, you can't say "let me drive by you again because I don't think I was speeding." Well, you can, but it won't do any good.
3. He was told that he was being placed under arrest. He asked why. They told him. He still wouldn't get out of the car. At that point, he was resisting arrest, which is a crime. If they had simply said, "we're detaining you for an investigation of a possible crime" and he refused he would be arrested for obstruction of justice.
4. "Oh, so I have to obey you?" Yes, you moron, you do. That's the way it works in these United States. As a society we require you to comply with police officers, that's how we keep social order.
5. Excessive force? Not at all. This man had already shown he was going to be defiant, and tazing him the officers insured that he wouldn't physically resist and possibly hurt one of them.

1. Learn to read. I said they are not required to tell you what the dog's "alerts" are. The pastor says that the dog didn't make a noise, and it probably didn't. Police dogs are specially trained. The dog's alert to contraband may not be, and probably isn't, an audible response. The dog could be trained to simply sit down and stare at the suspect area, or roll over and play dead, or sniff its ass, or lick its balls. The fact of the matter is that the police aren't required to explain to you exactly how the dog was trained to alert to any specific type of contraband. My first point, which you so widely missed, was not a matter of rights. I simply stated that they aren't required to disclose how the dog is trained to react to something.
2. You're right, he can request that they bring the dog by the car again. They aren't required to. One "alert" from the animal is probable cause for an investigation. It's a pity to see law enforcement officers act in such a manner, though. Police officers should be understanding, but firm, they should remain calm, and only use as much force as necessary, and they shouldn't abuse their power. A lot of people say, if you're not a criminal, you shouldn't be afraid of the police, but when some of them act like these men did, it's reasonable to be afraid, and it's hard to trust them to keep us safe from REAL threats when they're wasting time punishing some innocent citizen because he pissed them off.
While, I will admit, I'm not a huge fan of this pastor, as I've watched his other videos and he's not exactly a ray of sunshine, in none of his videos is he breaking the law. On his account there is another video (at least one other than this one) in which he seems to be antagonizing officers, such as others on here has mentioned. And he probably knew something like this would happen eventually when he goes around looking to fight with an officer, but bottom-line is, while he is rude and obnoxious towards officers of the law, in neither video is he breaking the law, and the police officers have no right to be unprofessional about it. (In the other video an officer went so far as to say "i'm pretty sure your a terrorist", and while no where near as awful as what the officers in this video did to him, I find it rather unprofessional of an officer to lose his cool while on the clock and acuse someone of being a terrorist, no matter how annoying they're being.) I think officers should be better trained to handle such situations with dignity, and to remain calm. It should be part of the training for them not to lose their cool with people, because while they may get angry with someone on the job, that anger can go too far, and someone seething with anger who has power and a weapon is DEFINITELY not a safe mixture.

whenever i'm home from tour of duty if there is a situation where i get pulled over i abide by the officers' requests to an acceptable extent. although i do practice my full rights while doing so. as far as i am aware there are only a set of questions that you are legally obligated to answer at routine checkpoints and after being pulled over, in my state we have no law stating that we are obligated to answer any other answers than the norm at state borders. as far as i'm aware the pastor was abiding by the law, and even requested requisit proof of the officers claims when another branch of law enforcement arrived ( which is another inalienable right.) unless something else occured in that situation that i'm not aware of the pastor was within his full rights. i didn't enlist in the usmc to watch our freedoms to be trampled upon or bastardized. unless law enforcement officers can prove otherwise they should all receive reprimands for use of excessive force and gross dereliction of duty.

They are BORDER PATROL. They are not held to the same standards that police are. They have full rights to ask ANYONE to step out of the vehicle and search person and car for ANY reason. They have the right to take your car apart piece by piece and if they find nothing, simple say "have a nice day." and are not required to put anything back together. Border Patrol is on a federal level and this guy will lose. If you think you are being wronged, you comply now, video tape it, then present your argument to proper authorities. Lets look at this. Yes, the guy should have answered the questions, which he does not have any video of, WHY???? I don't know....
DPS is the group that made the arrest. It was the DPS who made the arrest based on the info they were given from the border patrol. The border patrol told the DPS that the dog gave a sign of drugs or a body, again he has no video of the dog. WHY????I don't know. So the DPS only acted on the info they were given and they had all the right in the world to remove the guy from the car. At the end of the day the only one that is at fault is the dog for telling the border patrol that there was drugs or a human body in the car.

They certainly used excessive force, but you could have avoided the entire situation by complying with their request for you to step out of the car. Failure to obey a lawful order is a crime, and gives the officer cause to arrest you. If you believe the officer is in the wrong, you take action later through the courts, not with the officer at the scene.

Do I think he has the right to refuse answering question and having his car searched? Absolutely, but when a routine stop has escalated to threatening arrest you are just making this into a fight (hence the camera). I don't know about you but I don't just keep a camera with me at all times and when a cop comes to my window think "hey this is going to be great video footage"(totally excluding Phil from that statement).

It's like every insecure idiot that gets fired from normal jobs or kicked out of the military becomes a cop. Not to say that all cops are bad or evil, because I know plenty who are not. There are lots of great cops - and I have nothing but the utmost respect for them. I'm talking about the others here. Way too many power tripping or insecure pricks with a chip on their shoulder become cops and are looking to take their problems out on innocent citizens. Many seem to do it for nothing but the power. There should be some filtering mechanism in place to keep these degenerate scumbags from ever getting hired into a position of such great "authority" and power - or at least to get rid of them quickly and permanently. After about 20 mins of asking, he says cause he asked some kids mom something, about as reliable as the dog, and then decides to hell with it, whips out the Mace, the nightstick, and mighty boot. Eyes red, hand broken, face on the ground and slowly dragged to the nearest clinic, which you have to wait in line. Hell, that's even been than this guy. This story only had one Cop (if you can call them that when they do this sort of thing).
Even if what he says is a stretch, both the cams in the first video go together. There is no doubt that they did break both sides, and dragged his out of his car, and had to drag him into the office.

If YOU were a LAWYER, I would give your OPINION more weight. A cop's daughter should know that hearsay is inadmissable.
First, you DO have the right to know why you're being searched and why you're being arrested. I believe in this case he was told the search was for suspicion of drugs, which they legally can search his car for. But they gave no reason for the arrest. While I'm not sure about the dog thing "My drug dog barked" seems highly suspicious and, you DON'T HAVE TO CONSENT TO A DOG SNIFF ANYWAY! It's a form of searching.

By refusing to cooperate with the police makes him suspicious and therefore the following occurred.
If he had nothing to hide then honestly he had no reason to provoke the officers to forcefully remove him from the vehicle.

I feel he was wrong on this, for the most part a dog alert is considered PC for a search and not cooperating is an obstruction of jan officer in the performace of his duty. He should have known why he was arrested as soon as he started demanding the dog come back out, ..........give me a break. The dog is a tool for officers to use, not a circus show.
These type videos are all over youtube, it's starting to look like a fad. In fact it is very dangerous to play around with the police like that and to act like your an attorney. Those guys have a job to do and letting someone go after a dog has alerted is not normally part of the deal. He started acting like they were pointing a camera at him and they were avoiding showing his face, in fact the camera was a static camera. Your going to bleed if your covered in glass. He should have just let them in the car. You ask for trouble and you get it, in my opinion.

Now I think both parties were at fault here... I think the officers could have used better judgment, but refusing an order by a police officer does not help anything. Either way, I don't really believe we have the whole story here anyways. If I had been in his position I would have opened my trunk, regardless of my rights. I would have then asked for their name/badge number and ask for a supervisor to log a complaint or follow up with whatever legal actions were available to me.

Dogs can alert in many different ways. By sitting, pointing with the nose or scratch, bark or laying down. You won't necessaryly see it happen. In the preachers defense it does sound like the dog was used in an effort to meet the PC rule. He should have instead of refusing challenged the dog in court and sued.
The man had no right to resist the search. Under law, the Border Patrol Agents could tear his car apart until they were satisfied that there was no contraband or human presence in the vehicle. Who knows, maybe this Pastor smokes weed... it is not as rare as you think. He might have even run over someones joint on the road a few miles back.
The Border Patrol Agents do not use Tasers... a police officer did. This is where it went wrong, so I think. He was not actively resisting arrest... only passively resisting. They had every right to bust in the windows, though. They should've sprayed him with OC.

My grandmother got caught from speeding alittle bit, instead of the cop giving her a ticket. He demanded to see her insurance, she was about 62 at the time. She was digging it out but she has a very high stress disorder and had two years ago had a stent put in her heart. So she asked the officer if she could just go inside, he could come in aswell so she could get her medication. He told her if she moved ONE step he could legally have shot her. Mind you this is a 62 year old woman, with no criminal record whatsoever. The cop was fired about two weeks later due to my grandmother not the only one being tormented like this.
I had an issue with cops when I was younger aswell. I had an emotional break down from the stress of school. They handcuffed me nearly to the point of cutting off the blood flow, then locked me in NOT a prison cell but a mental hospital cell for three days with no bed and only water and a sandwhich.
I personally know how cops are and how they think they can do whatever they want. Our police department was taken to court, and we won.
So, no. The cops can't do whatever they want because the " think " there is a cause. Not everyone is a sick fuck with drugs stored everywhere. I am personally sick of being told I am this person or " could " be.

If everything the pastor said was true then he was within his rights to refuse the officers. Especially after the second set of officers asked them to bring the dog back out and they said no.
Some people say you've got nothing to hide so why not let them search. Well, if the dog did pick up something why not have the dog re-search the car in front of him to prove it? By law you must be proven guilty however that doesn't actually have to happen until court.
Last thing I want to say is, that the cops used tasers on a guy who was just objecting to them. He wasn't yelling, swearing, or physically resisting arrest. I say they were in the wrong to tase the guy.
In this case both sides have legitimate arguments. I understand the police search with probable cause, but a second sweep with the dog should have been made. As for excessive force, tazers were mostly not needed. It is hard to tell how many were used. A taser log would be a helpful tool proving or disproving police abuse.
Again this is an important case in protecting peoples rights. I have often sided with security over unbridled freedom because I have rarely done anything incriminating. The need to protect rights is so severe due to human nature to fully exploit and take advantage of any system. There are no consequences greater than the lost of rights, especially when unequally lost.

The thing with the 4th amendment is that it protects citizens against unlawful searches or seizure. He is correct that he does not have to submit to an unwarranted search. That does not give him the right to remain in his vehicle when asked by authorities to leave. The proper handling of the situation, and something most people should know in protecting themselves, is to remove the keys from the ignition of the car, place them on your person, so in any pocket. Lock the vehicle and close the door.
In evoking your 4th amendment rights it is safest to say "I do not consent to any searches" to an officer that asks to look in your vehicle. Since your property is now locked the cop will be breaking the law by forcing his way into your vehicle. Officers do have the right to pat you down and frisk you for their own safety and to check for concealed weapons. But they are unable to remove any item (such as the previously mentioned keys) and use them to gain access to your car.
His mistake was not removing himself from the vehicles, but honestly the fact that people do not evoke their 4th amendment rights in these situations gives most cops the impression they are capable of searching anything they please in the vehicle. This is just untrue. Most of the people here saying you should just let them search the vehicle even if there is nothing to hide, seem to forget that you are allowed to not self incriminate or allow searches with out warrants. Even with probable cause, you can still request a warrant be issued before turning over the property to be searched.
Since this is a border stop most of the things I mentioned don't hold up. Since it is a search being held at a border patrol station, the need for a warrant due to probable cause is waived. An is dictated as a Customs search instead of normal law enforcement services. The only time a warrant would be needed in a border patrol case is that of privacy concerns, or cavity searches. But the vehicle and its contents maybe searched thoroughly.

The pastor, when told he was being arrested for resisting, he should have gotten out... as to avoid the beating. Strike one for the pastor.
The cops should have taken proper steps by assuring the individual that this is a routine stop and that cars are being checked. They also should have stated that there has been smuggling of drugs into the country and that they are making sure that all these vehicles did not have said drugs. Since they do have a past of lack of brains and a past of doing things the wrong way, the do get a second strike.
Third, after checking his car and finding nothing, they should have taken him to the hospital and fixed him up, along with the county or state repairing or replacing his car. However, they arrested him on false pretenses and treated him with disdain. Needless to say, strike three.
The pastor should have all legal right to walk away from court with the arrest being taken off of his record, and be fully compensated for all damages to him and to his vehicle.
That is why you do not allow bad cops to continue on the force. They give law enforcement a bad name.
But for America, I'm sad to say I think your govt these days (well, for the past 50 or so years) has just lost it. Many places around the world see America as being populated by mostly nice people but having a regime that thinks its citizens are a commodity to be used and abused at will.

In the UK we dont have tasers in common usage, the actions that cops took would have only really happened if there had been drunk driving or an accident where he failed to stop, and they would have taken the 'softly, softly' approach and asked nicely. They would have also said something along the lines of "I have reason to beleive there may be .etc" Although you can't arrest someone without stating why. 1. If you listen to the first words out of his mouth in the hidden camera video, (well, let me ask you this, are you placing me under arrest)
This is something that most any director, amateur or not, knows is very common in a scenario such as this. You turn your camera on, and then get the, in this case officer, to confess to everything he's doing wrong while the tape plays; ask him in such a way that he almost definitely answers yes. "So what! Are you arresting me or something?!?"
2. When a cop tells you to cover your eyes (especially after you suspect some shit is up), why in the FUCK would you obey. An officer has no right to tell any citizen to covers his/her eyes (let alone bust someone's window open for politely refusing arrest). The only time a citizen should cover his/her eyes is if national security (or something along those lines) comes into question by them seeing it. At which point, if something like this comes into view of citizens, your ass is grass officer friendly.
3. How did he get the tapes back from these cops?
Although, it's not necessarily unheard of for a citizen to have his/her belongings returned to them, if these are crooked cops, they would find a way to hide the camera. If they couldn't they'd be in more trouble than job-loss.

4. Why does the camera women/man continue to zoom in and out. For some parts, I can understand, but it's as if he/she is zoom-happy or something. Another thing most directors know the human eye can perceive without the audience realizing it.

HOWEVER. He was told why he was stopped and why they wanted to search his car. He was asked to step out of the vehicle for it to be searched. The police are not required (to my knowledge) to go through a lengthy conversation about the validity of their probable cause other than to state what it is. By this I mean: they don't have to educate this guy on how exactly they interpret the drug dog's actions and then recreate the cause for him. They stated their cause and had right to search the vehicle and he decided he'd rather make things worse.
So both parties are wrong: the pastor by causing the incident, the cops by taking it too far afterward.
I'm not sure how many times he was hit with the tazor, but they were justified in using it to get him out of the vehicle. Once he was on the ground, using the tazor would have been excessive. As far as the video's show, the cops did nothing wrong.
They can't use the taser to get him out of the car, he wasn't resisting arrest (he was refusing to co-operate -- they hadn't said your under arrest), he wasn't fighting, he wasn't being threatening or aggressive.
Those border patrol guys completely over reacted, the violence, the taser, refusing to co-operate with him...

The pastor shouldn't have resisted. He should have stated clearly on camera that he was not in allowing the search and that his rights are being violated then fought the cops in court.
The sad thing is that too many people today are all too willing to give up their constitutional rights. The cops should not be allowed to violate those rights and if you allow then to take away your rights then they will expect the next person to do the same.
However, if you plead NOT GUILTY, then you can demand the cop to show the radar guns/ radar logs. But all that happens in court, not on the street

As for previous post by Pizza guy, like I said you can refuse a search on your car, you have a right to not self incriminate yourself and protect your life, your liberty, and your personal belongings. Since they refused to bring the dog back it showed the cops were lying. Tazering a defenseless pastor is just wrong. Since the only reasonable cause was the dog thing, since they refused to bring it out to actually see what the dog did, b/c apparent it just sat there is enough to break into your car is bull.

Bad decisions were made by the officers, were they excessive? Only those officers know, a video can not tell the emotions and the events that unfolded outside the view of the camera. Both windows needing to be broken? That was a bit too much. However the dog and the non-complience from the pastor was enough cause to make the pastor get out of his car. When he did not get out, what are the officers going to do? Wait for ever until he gets out, his doors were locked, they asked him and asked him to get out. Then, had a lot of respect when the advised him to close his eyes.
In conclusions this guy acts like and seems like a baby who needs atttention. I have been tasered, there is very little pain, but alot of non-controll. The tazer did its job and no one was seriously hurt. He caused this on himself. If he would have gotten out of the car everything would have been ok. Its easy to judge, but remember these guys deal with and see things everyday that would make you sick, all in an effort to protect you. They do not know what they are up against and for all they knew he had a gun.
Should he have just opened the trunk? Yes.

Fair advice to all of you going overseas for your vacations, leave an itinerary with your parents, and tell your embassy that you are in country, and call your family every few days. This is to protect you, your family, and your nation. He was lucky to be caught at the border in his own country.

As far as this situation goes, come on people. Multiple cops apprehending a single suspect don't need to use a taser. A bunch of guys with nightsticks, mace, and hand-to-hand suppression tactics can't take out a single unarmed holy man? Really?
As far as the preacher being stubborn, he's allowed. Sorry. There is no law that says being stubborn, lippy, or having a different opinion makes it ok to beat down a suspect.
1) comply with the request to get out and let them search the vehicle
2) get the names and badge numbers of every officer involved once the search is over.
3) go immediatelty to the nearest US ATTORNEY GENERALS office and file a formal complaint against each and every officer involved EVEN IF ALL THEY DID WAS WATCH.
4) contact a good bulldog lawyer ands file individual suits against each officer personally for violation of your civil rights and against the departments involved for each and every offense involved.
5) contact the news media and show them the tape. The media coverage alone will put every one of the police involved in a bad light to the public and they don't want that.
6) make sure that each lawsuit is seperate that way each officer will have to hire a lawyer to represent him/her out of their own pockets and even if they win it still costs them.
7)make the amounts requested outragiously high so as to attract the attention of the media again

Lets say you're caught drunk driving and you don't think you're drunk. Do the cops care if you believe you're over the legal blood alcohol level? No. It isn't their job to convince you. They told him why they wanted him out of the car. They gave him plenty of chances. He was removed.

If the dog accused him, then he's justified in asking to see what the dog did, his behavior, that indicated he was doing something illegal. And the cops can't arrest him on probable cause. They can detain him, place him in custody, but an arrest is only legal if there is proof and evidence against you. At the time, there was NONE. Only probable cause.
Police are not infallible. We are not supposed to blindly obey them. Without forward thinking men/women, this would wouldn't be half of what it is today. People are allowed to question the situation, innocent until proven guilty.
There was no crime, only probable cause. The only witness to this probable cause, was a dog. The dog was no longer around. I don't care how much a dog is trained, sitting down does not fully implicate someone of a crime. Dogs have three natural positions, laying down, standing and SITTING. Is it completely irrational to think, during the dogs shift at border patrol that it won't sit down at some point? So any time, for the rest of that dogs life, if it sits down, that means someone has a body in their possession or drugs on them?
And lastly, maybe if the border patrol and DNS weren't such dicks when talking to the man, he would have complied. They could have handled it very differently from the beginning. Why not say "Sir if you step out of the vehicle, we will bring the K9 back and show you exactly what he did to give us probable cause. But it's within the law for us to legally remove you from the vehicle and search it whether you cooperate or not. And we will bust out the windows and use a form of non lethal weaponry to secure you in our custody if you do not comply."
Resisting doesn't have to be a physical fight. It can be verbal as well. Telling an officer no or placing yourself in a position to resist (ex: not removing yourself from the car) IS resisting.
Bottom line, I would have gotten out. Probable cause, whether you agree with it or not, IS the law. And I would rather them search me and my car, knowing I have nothing to hide, than to not search someone who is. The 10 mins of my time is worth it and I respect those who are trying to protect us.

Failure to comply with an officer's request is only something you can be arrested for if the request was a lawful one. That's a very iffy situation, as their probable cause seemed to be pretty shaky. They beat the tar out of him, and that was totally unnecessary.
For all you stooges saying that they needed to taze him just in case he was a dangerous felon, they could say the same thing about anybody walking down the street that looked at them funny. Just because you suspect someone may be a dangerous person, that's not justification to beat/shock the hell out of them. K9 are trained in specific search patterns, and when they find something, depending on the trainer, they go into a sit-stay or down-stay NEAR the object until called away. It sounds as though the K9 was not even brought into the vicinity of the car for a proper search. When outside the vicinity of a search and the dog "senses" something they will go on alert, meaning there will be a bark, generally deep and short. The man heard nothing, meaning there was no alert.
Sounds like the BP wanted to search, probably quota, he would not get out, so they made something up. Patrol gets called in, has one side of the story, and for safety they will agree with the BP. Things escalated to the man getting abused and everyone involved looking like asses.
I bet there will be repremands and if there are any firing it will only be on the BP side of things and not the highway officers involved.

However, I do agree that the deployment of the tazer was dramatic given the number of personnel available at the time. Conversely, the tazer is deemed an "intermediate weapon" and not as lethal force. It can be used (in my state) in cases of active resistance or active aggressive resistance. The minister looked to be a classic "passive resistance". They could have opened the vehicle, again gave him to opportunity to exit and then physically attempt to remove him. If he actively resisted, i.e. physically pushing/pulling away from them, then the tazer would have been appropriate.

There was a recent case that I believe made it to the US appellate level affirming the use of dogs, but there continues to be further litigation regarding this issue and none has set a precedent of a "yes" or "no" for the use of search dogs as sufficient probably cause.
Nonetheless, the officer informed him of the dog's hit on the vehicle which is sufficient for a search.
So, if probably cause was articulated by law enforcement in addition to his demeanor raising their suspicions, his refusal to cooperate constitutes obstruction of the officers completing their duties. The probably cause and accuracy of the canine can be argued later in court.
The good minister took a situation that could have been litigated as a civil issue and turned it into a criminal law violation.

Second, there was no excessive force used. He was told what he was being taken out of the car for, therefore he was resisting after the fact. He was then immoblized by tazer for fear of being physically confrontational. He was then pulled to the ground, with force, and handcuffed.
The only thing wrong with it is people saying he was beat up. His face is that way from the force to the ground, which is standard procedure in hostile situations for cops.

also for the cops breaking the window, in the video you can hear the cop and see his mouth moving as he puts the hammer to it. he said, "close your eyes" the guy knew the window was about to be broken. he was being civil disobedient, which many people think they have a right to do. and they do, but most forget this idea is based on the idea of being punished for being disobedient, and you bring attention to the situation when you are punished. This man maintains he did nothing wrong and was not made aware of his crime. they told him he was resisting arrest and was impeding justice. he was constantly talking and would not listen to the answer from the cops.

While it may have been antagonistic of the guy to refuse cooperation with the border patrol it is also is RIGHTS under the United States Constitution to refuse to be questioned without a lawyer present or to be search with no probable cause. As far as the dog is concerned; that is the most obvious abuse of power in this whole scenario; instead of granting this person his rights as an American, they instead concoct a BS false positive alert from a dog. Ok if you are innocent then why wouldn't you answer their questions? It's their job to make sure some one doesn't bring in drugs/weapons/people illegally. By refusing to answer the questions you are basically giving them a reason of suspicion. That right there is probable cause for them to search the vehicle.

As for him being pulled out of the car. He says that one of the officers "steps" on his head. But in the video the only officers around him are all kneeled down on top of him.

Sniffer dogs aren't trying to find drugs, they are trying to find their ball which has the same smell!
The handler can also train the dog to scratch at a car or even the bare ground on command (usually "go on, get it, get it) in order to create reasons for probable cause.
So basically if they go as far as to get out the dog they are going to get into your vehicle and search it one way or another. Honest or not.
I think that this guy planned everything out. He is probably planning to sue Border Patrol and get huge money out of them (again taxpayers money). That is why he must have behaved erratically and in a strange way when they stopped him. I don't think anybody is stupid enough not to open the car door even when you see 5 cops charging you with hammers and tasers in their hands.
Also there is a reason why cops are not supposed to show you the proof of cause while doing the check. Hell, they are there for doing the check and maintaining the security. A few of you are saying that based on his politcal and religious views is the reason he got what he deserved. But no, the cop couldn't use his pea brain to think of an intelligent response or any response for that matter as to why they were arresting Pastor Anderson. If I was cop and heard about this, I would be ashamed to wear a badge. I you can throw out the police motto: "To serve and protect." You can change it to: "To hurt, to mame, to beat, to kill." That is what the cops in the United States are doing. They tased a women unconscious than beat her up. You people support police who do that. The women couldn't even defend herself.
It is so easy to support the police when its someone else getting stopped or beaten, or whathaveyou. When its you, your tune suddenly changes.
Once the windows were broken, things changed. He said himself that once the windows were broken he was surprised and completely off-guard. Were the tasers necessary? Definitely not. From there, I couldn't make anything out from the videos and don't really trust his word, but it was out of his hands at that point.
The border patrol / DPS lost all credibility when they attacked this guy. Smash out the window, fine. Unlock the door, fine. Pull him out of the car, fine. Place him under arrest (for something other than resisting arrest), fine. But that's not what they did. Had they done this, the lack of explanation might have been overlooked.
But no, these guys were looking for something to do, and had something to prove.
They tased him, beat him up, harassed him... why? Because he chose to exercise his rights. Primarily the Right to remain silent and Right to privacy.
Also, according to him, he didn't cross the border. It was a check point that runs parallel (could be wrong, but that's how I heard it). He was probably just lucky number 11, and got selected for a random search.
And yes, the dog alerting them was very likely garbage. I've been in the exact same situation and likewise, in mine the K9 walked right past it, they said it alerted them, they searched my car... a car that never at any time had drugs. I was more cooperative, but that's because I lack the spine this guy displayed.
The "authorities" blew it. Simple as that. This guy politely explained that he shouldn't be bullied into forfeiting his rights. Not something these guys were willing to hear.
One last thing... The Border Patrol only recently received a huge influx in funding. A lot of these guys were possibly new and inexperienced. No excuse.

The 4th amendment protects you from unreasonable search and seizure, that applies to check points as well. The notion that there was a border patrol check point more than 50 miles from the border is ridiculous in itself. This is not natzi germany where the police can stop you without cause and demand your papers.
The 5th amendment protects you from having to provide basically anything beyond your name to the police.
The 8th amendment protects you from cruel and unusual punishment. Which this guy clearly experienced.

I think it really is a 20/80 blame for both parties. 20 for the pastor because really, in a day and age where people are getting killed for refusing to obey the police, he should've judged the situation more carefully and just let them search his car and if he felt that his rights were violated then, he could've pressed charges. 80 for the cops because that amount of force as described and as seen on the security footage is just ridiculous. Somewhat reminds me of the cop kicking the girl in the face for tossing a shoe at him.

I can't tell you how many times we have been pulled over for (Random) car searches and had the inside of our car completely trashed, drinks spilled, and stuff thrown on the floor outside of the vehicle.
When we asked about our rights regarding unlawful search and seizure, the officer threatened to arrest us for failing to comply with police business. We don't even try to file complaints anymore, we will always be wrong.
I haven't had any trouble since I was a teenager, but on multiple occasions I dealt with bored cops looking to harass some kid with no way to fight back.
This pastor guy speaks coherently to the police, ask reasonable questions, and did nothing to warrant this kind of attack.
Let's hope it sheds some light on the Yuma DPS records.

Both times I refused to allow a search. They stated they had probable cause to do so. I insisted on a warrant showing that - because even if they have probable cause they have to get a warrant, unless you are being arrested.
Funny, when I insist on finding out why I'm being detained and what I'm being arrested for they end up telling me to drive safe and get on my way.

Fact 1. Police dogs DON'T show the type of reaction to finding drugs, people etc. that a 'suspect' would expect. They have a signal which their handler will understand. That could be as simple as sitting down
Fact 2. Police dogs do make mistakes. Due to cross contamination false alerts are common.
Advice: Although you may have done nothing wrong, if you have nothing to hide why not just help the Police and co-operate. They are doing a tough job. If every genuine drug dealer thought they could just refuse to be searched and the Police would let them go on their way then...... well drug dealing would be very easy and we'd all be doing it :-)

There seemed to be plenty of warning. I wouldn't think it would be pleasant to get pulled through a broken window and detained by force. so i have little pity.
The use of tazers has time and time again been ruled well with in the bounds of reasonable force in cases of resistance.
I've grown sick of this "we live in America" thing. Living in America is not a valid reason to resist an armed authority figure that has been trained and authorized by America to enforce law. You may file a claim after your arrest if you want, but if you resist arrest you are guilty of an actual crime.
When a cop tells you to do something, do it. He should have allowed them to inspect his vehicle. Instead he wanted to pretend he lives in some mystical wonderland where cops are 9-5 customer service representatives with guns. That some how he could dictate their operating procedures or had a right to a "retest". As a result he was extracted, patched up, and detained. This is a better scenario then stuff i have seen from nations outside of the US.
So all you excessive force peoples, be thankful you live in America where the cops don't force you to pee into a bottle for their amusement, or just take you straight to jail with your forehead open. Be happy they provide clear and obvious warning before they go breaking windows. Be happy you are allowed to tape the incidents like this and get footage from other cameras. Be happy you can freely post this on the internet and get responses from would be anarchists. Our police do not drink on duty, and typically are not mentally damaged in obvious or dangerous ways. America has an above average expectation of its police force that it meets daily. Every now and then you get a slip up, but this is not one of them.

3.They had no reason to search his car. Lets say I'm in a cop and I walk a k-9 by your house, and say, hmm the dog sniffed toward your house. so knock knock, I have a reason to search your house. Right?
If the authorities thought this person was a threat, they could have just detained him within his vehicle, and not physically abuse him.
I agree that in most cases we should respect the authorities and do what they ask, but at what point do you have to question them and what they are asking...(if he had gotten out of the vehicle, and they asked him to strip in public, would you do it, then they wanted to preform a body search, would you do it...) All knowing you are innocent.
He did not "cause" the problem, the problem began when the authorities lied.

One taser is fine if he were resisting once the police forced entry into the car. That can easily be accepted. However, multiple simultaneous tasings surpasses the level of reasonable force. A boot crushing his head into the ground while being tased after being removed from the car, when he was NOT resisting arrest FAR surpasses reasonable force.
Being heckled after arrest is inappropriate and those Border Patrol agents should be reprimanded, and placed on unpaid leave while they are prosecuted for police brutality.
If I were admitted to the Arizona Bar, I would have no hesitation in offering my services, pro bono, to this pastor. I may not care for his religious beliefs, but I do care for his civil rights. I do care that police govern themselves by the constitution, in the same manner this man did. It is clear to me that both CBP and DPS should be brought before a court and prosecuted.

Now I am not saying that this gentleman was doing the right thing, he clearly is in the business of stirring up trouble where he can but so were the border patrol agents and the DPS officers.
In today’s mentality we accept searches (be it on the airport, miles away from the border on roads) without any problem because it’s a fact of daily life and for the common good, but that does not make the search legal or even justifies that search. We just accept it as a way a life.
Every so often someone does not accept this and asks questions and instead of backing down when he see that the law enforcement is not behaving as they should they continue escalating the situation.
He should have gotten out of the car, taken names and badge numbers of the officers involved and then after the search driven to the US Attorney’s office to complain.
He clearly did understand that if he does not back down that this would escalate to a point where it would become so unstable that all involved would regret this for long period to come.
Clearly I’m blaming both sides here for what happened.

I've read about many a story like this. We should always be reviewing our police force in the west in order that we may be found blameless (or near so) when we turn up somewhere else (e.g. china demonstrations) and tell them what to do.

It's still true he had every right to do what he did, but he doesn't seem to have any excuse for just being an asshole every time he meets a police officer. Nobody's going to want to calmly reason with an angry idiot.

This man, was not being unreasonable by any means nor threatening to the police officer and co-operated when they told him to put his hands over his face. At this point in time, not only is he obeying and passive but he is also defenseless! On top of all this there is not just one police officer, there are many. Under these circumstances the way this man was treated is pretty much a crime. To say that this was not excessive force would simply be ignorance. Even if he was resisting under circumstances where he was going beyond his rights, these men could have easily handled him without hurting him.
These men deserve to have their badges revoked and banned from law enforcement.

I realize that there are bad cops, just like there are bad people in every job(such as say, pastors?), but for the most part, if you do what they tell you to do, you won't get the crap kicked out of you. I've had encounters with law-enforcement and the military, and if you aren't intentionally doing anything wrong(such as wandering past a restricted zone on a military base or stopping to ask police for directions), they will firmly but nicely correct or help you correct the problem. When a person refuses to answer simple questions(like he apparently did when they first stopped him) it become suspicious behavior. Then when you refuse to let them do their job(search your car, search you, run your license, all that jazz) you are reinforcing their beliefs that you have something to hide or are participating in criminal activity. Then when behavior becomes a possible threat to them or the civilians around them, they need to act. That guy refused to get out of the car. They committed police brutality. This is common beyond belief. I have suffered from it myself. Someone phoned in a lie about me to the police which they had to take seriously and they broke into my house under the assumption I was armed and dangerous (not true) and proceeded to beat me.
When police officers let the adrenaline of the situation make them lose control and turn into vicious monsters we are all possible victims. I didn't do anything in my situation to warrent what happened to me, and this preacher pretty much just put the system to the test to see how it works out. He did nothing to pose a violent threat visibly so why was he tased? Why didn't someone have the common sense to realize there was broken glass there and they would need to proceed extra careful with the arrest?

If an officer wishes to "force" you do be searched or enter questioning he must arrest you and/or gain a search warrent.
If he is to arrest you he must be able to prove in a court of law that he had reasons that if found not adequate the case will be thrown out regardless of what was found during the search as the search is declared illegal.
Warrents can be issued for random stop searches but these officers superiors would have to be able to produce such a warrent if the officers were challenged.

According to law, police officers have to provide a reason why you are being under arrest according to the fifth amendment (?) of due process. Police officers are not allowed to arrest someone because a police officer was not being listened to. If you are stopped and are told you are under arrest and they will not provide a reason, it is 100% legal to drive away. You do not have to talk to a police officer if there is no reason for them being there.
Not only did those police officers use excessive force, they violated the 5th amendment of the U.S. constitution. In my opinion, all of them should be fired, fined, and sent to jail for a few weeks.

I'm not saying that standing up to abuses of power is a bad thing, but there's a fine line between exercising your rights and putting law-enforcement people in that situation.
By refusing to leave the vehicle, after being told he's being arrested, he basically forced their hand. Not only that, he is clearly exaggerating the extent of the "beatings" - if he'd been repeatedly struck, I'm sure he'd have at least some bruising.
It looks like he got tazed, thrown to the ground, and handcuffed - the cuts are not long, like he was being dragged around on the ground - just impact from being tossed out of the car and held down while cuffing.
Bottom line, it's not his job to determine if the dog detected anything or not - when he was told he was under arrest, he started resisting arrest by failing to cooperate and forced the cops into the situation.
Why oh why is their a point to police protection of citizens if the laws clearly stated in numerous places do not apply to these men?
Was he unnecessarily stubborn? Yes. But as a citizen it is your RIGHT to know under what grounds you're being arrested. It is YOUR right to refuse search without proper consent, reasoning, or warrant. If you would like to ignore these rights, then I'd like to ignore the police and military in place who DEFEND (supposedly) these rights.
If you're going to defend these sorts of actions under the claim that these men are actively protecting you, you might as well understand this. The laws that protect you apply to everyone. You cannot pick and choose when use of ones rights are appropriate, they apply to all citizens no matter what. If you're going to claim that officers have jobs designed to protect us, then you must also concede that the laws they, the officers, MUST (always) abide by are in place to protect us.
Furthermore, several statements made defending the police come with mindful contradiction. This man wasted their "man power" and "time" about as much as the police did his and their own. There are other videos which clearly show the officers are laughing, in fact, calling him a "terrorist" and laughing that they were going to break down his windows because he invoked his 4th amendment right. They wasted their own manpower and their own time, and they wasted your hard earned tax dollars doing it.
That's right, you're paying out the ass so that these men and women can exercise protocol in situations that do not require excess force. This is a great example of government workers and officials wasting money for unnecessary reasons. These men did not have a hand that was forced. These men did not have to spend excess time harassing and beating this man.

This is disgusting. Our country is falling apart. What can we do to fight this destruction of our world and people? Is there any hope for us at all? We are turning into disgusting monsters, thriving on the pain of others and grasping at any glimmer of power we can. Our world is turning into a disgusting place and the only way to get out of this is to focus on the community that we might be able to restore. Blind hatred is what is fueling this. People are not drones to blindly follow the government, and yet the federal government thinks we are. We need to learn to not hate, not strive for power in petty and destructive manners, and most of all do not trust the government, which should be here to protect us (which is what they are claiming to do by "fighting terrorists" and starting wars) but then treat us like trash at the drop of a hat. We need to start a revolution against this fascist oppression that is slowly but surely oozing it's way into this country and the minds of the people who live here. We are not safe in our own homes when the government does not trust it's own citizens. So, in the words of N.W.A., fuck tha police.
I hate to tell you, but sh** is happening that isn't supposed to be happening everywhere and not just to you............this is evidently the first time you have experienced something like this.......THOSE TASERS SHOULD BE OUTLAWED...........Cops are people.....there are good cops and bad cops (Drew Peterson).......the problem is when a bunch of bad cops form their own little group.......
With all this police brutality, what are our congressmen and women doing to stop this? They see it on t.v...........they have computers.........

Second, refusing any lawful, reasonable order of a police officer is a crime. He can't tell you to bark like a dog or cluck like a chicken, but if he tells you to get out of the car and you dont, he will remove you. He was already under arrest for refusing to go to the secondary area.
Third, the reason they broke both of his windows. They broke the passengers side window out so the other officer could taze him safely and effectively. It is a lot easier for an officer to taze someone from a distance than to do it from the drivers side. Not to mention it would be hard to hit anything other than the face. They then broke out the drivers side so they could remove him from the car.
From what we can tell from the video, there is no excessive force involved.
The man was wrong by resisting to answer the simple questions and not getting out of the car, AND the cops were wrong for using wayyyy too much excessive force. Both parties were out of line in this case and both should be punished.
And btw, there are checkpoints like this (miles away from the border) because there is a great deal of drugs and human trafficking going on in our great U.S. of A. I live 15 minutes away from the US/Mexico border and when I am traveling due north, I do pass one of these checkpoints. They are usually quick and smooth as long as you don't act like an asshole or the dogs detect something (of course)... so for this guy to have been stopped in the first place, he must have been acting like an ass. He even had a camera rolling!!! For all we know he acted that way on purpose just to get some attention// possibly get money from suing them!
This guy is dumb but the cops definitely crossed the line....
Answer the questions asked of you and try not to make trouble just because you "rights" said you could!!!
granted I think the police were excessive with their actions...
However... pretty simple don't act like you have something to hide at a border crossing or check point.
If you hadn't already been hit in the head I would swear that you had prior to the incident.
This man was clearly and completely within his rights under the 4th Amendment, and should have been clearly told what his crime resulting in arrest was (which, by the way, makes no sense whatsoever, in the context that arrest occurs under probable cause, which brings us back to the dog) and shown that the dog had displayed some form of warning that there were illegal paraphernalia or bodies stowed in his trunk.
And another issue not discussed: this dog? Yeah, it's a DOG. Not exactly what we'd call a flawless drug-busting machine. Yeah, the dog's been trained, and you can say what you will about the aspects and scrupulousness of government canine training, but my dog won't even sit on command. How are we to know that this dog didn't make a mistake, as any creature can; and he obviously did, as there was nothing in this man's car in the first place.
Now don't get me wrong; I'm not some "soldier of God" or "God's BFF", or some "anarchist freedom-fighter fighting the conspiracy, man." I'm simply a liberal, Agnostic-Atheist, and say what you will. But this man said NOTHING about God. He did not bring his religious beliefs into the situation at any time. His profession and beliefs do not and did not interfere with this situation, and I deeply respect and admire him for what he has done. A man is not an "asshole" for exerting his rights in a civil manner, and if someone is an "asshole" for doing so, then I guess I'm one hell of an asshole.
We all know that if this man had just gotten out of the car, opened his trunk, displayed his lack of illegal paraphernalia,and complied with the border control, he would have been on his way in fifteen minutes; but this would have just been another simple display of the government being, as previously stated, the "Mommy", and the U.S. citizens being the "children", to be told what is right and what is acceptable. Agreed, we must follow the law when it is just, as a law is meant to be, but as the American people have rights, they have the right to exert them when a law, or supposed "law-abiding and enforcing" citizen is not just. And if this means getting beaten and bruised and laughed at and even arrested, and it can be one more step towards the freedom we truly deserve, then I say: Do what it takes.
Normally I tend to side with law enforcement, however this was excessive.

These officers do not have the luxury of assuming anyone they come in contact with is an honest citizen because their lives are at risk. That being said..... I think the BP and DPS over did it. The guy would have got out of the car eventually on his own. He was going to have to take a leak or get a drink of water sometime. The pastor was correct about unlawful search & seizure.....it is our 4th ammendment right.....
If you are so ignorant as to agree to answer questions of an overpowered, boarder patrol person, who then feels your rights are not valuable, shame on you to call yourself an AMERICAN!
The constitution was written to PROTECT YOU FROM GOVERNMENT, that includes Boarder Patrol, and Police OFFICERS, and Even our great PRESIDENT, we as the "small and weak" are protected but if we as the "small and weak" don't stand together and call our government to uphold the LAW, and CONSTITUTION, which is the HIGHEST LAW, then we might as well move to China or India, where people are killed for something as simple as what this pastor did, what would have happened if this pastor was killed, then would you think differently that these police officers face in their job?
What if this was your son, who was abused? What if this allows your local police officers to enter your house at 2am just because they have "probable cause," and in their actions are found to be wrong and actually find that police officers break the law? What if the police begin to KILL on site because of "probable cause," and human error?
I pray, that we as the "small and weak" will begin to defend our rights as humans and furthermore rights as AMERICAN "honest" Citizens!
And of course this pastor was found NOT GUILTY of having Drugs or a dead person in his car, so NOW WHAT??? The police where wrong, but still this guy got tazed!

Everything was fine up until one key moment, and this is very key:
They committed police brutality. This is common beyond belief. I have suffered from it myself. Someone phoned in a lie about me to the police which they had to take seriously and they broke into my house under the assumption I was armed and dangerous (not true) and proceeded to beat me.
When police officers let the adrenaline of the situation make them lose control and turn into vicious monsters we are all possible victims. I didn’t do anything in my situation to warrent what happened to me, and this preacher pretty much just put the system to the test to see how it works out. He did nothing to pose a violent threat visibly so why was he tased? Why didn’t someone have the common sense to realize there was broken glass there and they would need to proceed extra careful with the arrest?
Why?
Because they don’t care. They enjoyed torturing him. Trust me, I know. They live in a life where every day they spend the entire day with the scum of our society and so once in a while they cross paths with a regular joe and mistake us for scum. But at the root of it all this is how they treat people!
I’m a white guy, I look pretty much the same as the preacher. I have no criminal record, hell I used to work in childcare and when I was younger security. I was always on the right side of the law.
So if I can get tortured because someone who hated me went to a public phone and made a bunch of false claims about me then it can happen to any of you as well.
I think this video is important because it totally shows the truth. It’s like treating people in this way is standard procedure now in North America.
Ask yourself if that’s fare to those falsely arrested who haven’t had a chance to be proven innocent.
And just so you know, no charges were laid against me. The police swept the whole thing under the rug as an invisible mistake.
I bet they try the same thing with the pastor.
I hope he doesn’t allow it. If I had my incident on film I promise you those officers would have lost their jobs and been charged.

Had my brother (a cop) watch it and he simply said that it was one of the times a cop with a cocky attitude and a feeling of empowerment gets into a spot they can't back out of without feeling their authority lessened.
That is, that was a either burned out or a simply bad cop.
Learn your laws before you act like an idiot next time. Had you just exited your vehicle you would had avoided all of your troubles.
While yes he should have just let them search his car, it was still an abuse of power by the police.
But dude, you should really see if you could sue them for that. They deserve to lose everything they have for what they did to you.
4th ammandment or not if your going threw a boarder patrol point and the officers tells you to exit your vehicle or ask you questions then you listen and obay.
If your driving from the US to Canada (or Canada to the US) Boarder Patrolers are responsible to inspect ANY and all suspicies vehicle. The only reason people are making a big fuss is cause this guy was a pastor.
He even admits RIGHT AT THE START of his own video that he REFUSED to give out ANY information.
Now if i was a cop, and a vehicle who was going threw my controle point looked suspicious and the guy driving it (REGARDLESS THE FACT HE IS A PASTOR OR NOT) does not want to answer any of my questions then id certainly be suspicious.
And to be honest they worned the guy several times to exit his vehicle and cooperate.
Also his injurys are REALY not that bad. They seam more like the results of having your face pressed againts the asfult. The officers forcefully removing the guy from his vehicle and he probably struggled a bit too. The officers did NOT kcik the guy down or hit him sencessly or anything. This is a textbook way of dealing with the situation.
My final comments is this.
1) Congrats to the fine officers in this video who delt with the situation in the best way possible. I would had done the same thing too if i had a suspicious vehicle at my controle point for more then an hour.
and 2) If your a Pastor and your legit why the hell would you NOT simply open the trunk and follow the instructions. That would had taken you oh about 5 min. IF YOU HAD NOTHING TO HIDE! The police officers are there for YOUR protection and to get the drugs off the streets.
